[00:00] Attorney: Hi, is this Marcus Ortiz?
[00:02] Attorney: It's Rachel Whitcomb from Whitcomb Family Law.
[00:05] Attorney: Before we get going, I record calls to keep accurate notes.
[00:09] Attorney: Is that okay with you?
[00:10] Client: Yeah, that's fine.
[00:12] Attorney: Great, so today's September fifteenth.
[00:14] Attorney: Your voicemail said there's a letter from your ex-wife's lawyer.
[00:17] Client: Yeah, um, so Lena's lawyer, Gregory Paskett, he's with Paskett and Low.
[00:23] Client: He sent me a letter dated September eighth.
[00:26] Client: They want to cut my Wednesday dinners with the kids.
[00:29] Client: That's the only time I see them during the week.
[00:32] Attorney: Okay, remind me what the current schedule is.
[00:35] Client: Every other weekend, Friday to Sunday, and Wednesday dinner, five to eight.
[00:40] Client: That's from the parenting plan.
[00:42] Client: It was entered, um, March twelfth, no sorry, March thirteenth, 2024.
[00:47] Attorney: And the children are Mateo and Sophia.
[00:50] Client: Right, Mateo's nine, Sophia just turned six.
[00:53] Attorney: What's changed since the plan was entered?
[00:55] Client: So Lena started a new job at Crestline Medical Group in July,
[00:59] Client: and she's working nights, like, three nights a week.
[01:03] Client: And on those nights, the kids stay with her boyfriend, Travis Keen.
[01:07] Client: I don't have anything against the guy, but I'm their dad.
[01:10] Client: I get off work at four, and Mateo's missing school.
[01:14] Client: He told me he's missed, like, four days at Linwood Elementary since school started,
[01:19] Client: because nobody got him up.
[01:21] Attorney: Do you know that from the school, or from Mateo?
[01:23] Client: From Mateo, I haven't seen any records.
[01:26] Attorney: Okay, we'd want to verify that.
[01:28] Attorney: What are you hoping for?
[01:30] Client: Honestly, fifty-fifty, or at least I get them on the nights she works.
[01:35] Attorney: Understood, I can't promise how a judge would see it.
[01:38] Attorney: Here's what I need from you.
[01:40] Attorney: The parenting plan, the September eighth letter,
[01:42] Attorney: screenshots of any texts with Lena about her schedule,
[01:45] Attorney: and your own work schedule.
[01:47] Client: I can get all that to you by Friday.
[01:49] Attorney: Good, I'll have my paralegal Dana pull the court file from Harlan County Family Court.
[01:55] Attorney: And I'd like to get a response out to Mr. Paskett by September twenty-second,
[01:59] Attorney: so they know you're represented and that you're not agreeing to drop Wednesdays.
[02:04] Attorney: No, please don't respond to Lena or to Mr. Paskett about this directly.
[02:08] Attorney: Let it come from me.
[02:09] Client: Okay, and um, how much is all this going to cost me?
[02:13] Attorney: The consult fee you already paid covers today.
[02:17] Attorney: If we move forward, I'll send you an engagement letter
[02:19] Attorney: that lays out the retainer and the hourly rate,
[02:22] Attorney: and we can talk it through then.
[02:24] Client: Okay, oh, and one more thing.
[02:26] Client: Does Travis have, like, a record?
[02:28] Client: Can you find that out?
[02:30] Attorney: I don't know yet, and I don't want to guess.
[02:32] Attorney: I'll look into what's appropriate to check.
[02:34] Attorney: Let's start with the documents.
[02:36] Client: Right, right, thanks, Rachel.
